You must be 13 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Judging; Selection of Winners; Notification; Acceptance. On or approximately January 30, 2012 the Contest judges will select the top 5 Photos through a combination of popular user vote and panel of Contest judges (weighted as follows: (A) popular user vote (45%); and (B) panel of Contest Judges (55%) (the "Standard Contest Weighting"). Contest Judges will judge Photos on the basis of overall appeal of the Photo, including, but not limited to, the appeal of the setting and couple depicted in the wedding photo. In the event of a tie, the tied entries will be re-evaluated against each other by the judging panel based on the criteria below until the tie is broken. One (1) first-place winner will be selected from the top 5 Photos through a combination of popular user vote and panel of Contest Judges, weighted via Standard Contest Weighting. Sponsor will announce the winners on or about February 1, 2012. In the event of a tie, the tied entrants will be reevaluated against each other by the judging panel based on the Photo criteria above until the tie is broken. Judging in the Contest will be by a panel of individuals selected by the Herald and News and who may also be employees or agents of the Herald and News. Entrants selected as potential winners must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Potential winners will be notified by phone or email. If a potential winner is not present at the time of the notification and a telephone message or email can be left by Herald and News at that time, he/she will have forty-eight (48) hours to accept the prize by returning Herald and News' call at the number provided by Sponsor or returning an email at the email address provided by Sponsor. The potential winner will be required to execute and return to Herald and News the following in order to claim his/her prize (collectively, the "Acceptance Documents"): (i) An Affidavit of Eligibility, a Liability Release and (except where prohibited by law) a Publicity Release in the form(s) provided by Herald and News, and (ii) any other prize acceptance documents in the form(s) provided by Herald and News. The Acceptance Documents must be returned to Sponsor by the date and/or time indicated by Herald and News. If a telephone message or email cannot be left by Herald and News at a potential winner's phone number or email address when the Herald and News places the notification call or email, or if the potential winner does not return the notification call or email within forty-eight (48) hours of Herald and News' first attempt to contact the potential winner by telephone or email, or if the potential winner fails to return the Acceptance Documents within the specified time, or if the potential winner is found to be ineligible, or if the potential winner does not comply with the Official Rules, then the potential winner may be disqualified and an alternate potential winner selected by Herald and News in his/her place based on results of contest popular vote and panel of Contest Judges, via Standard Contest Weighting. In such event, an alternate potential winner will be notified by Herald and News by telephone or email as described above and will be required to return the required documents to Herald and News as described above; however, Herald and News, in its sole discretion, may adjust the above timing and delivery requirements to accommodate Herald and News' Contest schedule, and due to such schedule and timing, Herald and News may be unable to award the prize with respect to the disqualified potential winner. Herald and News is not responsible for the failure of a potential winner to receive Herald and News' telephone or email message or the Acceptance Documents for any reason, or for the inability of such potential winner to return Herald and News' telephone or email message or the Acceptance Documents for any reason. Winner agrees that he/she will not conduct or participate in any media interview regarding this Contest or any prize without the express prior written permission of Herald and News.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If Herald and News cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
Automated voting of any kind is not allowed.
Detection of said automated voting will lead to votes being voided.
Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.
Herald and News reserves the right to substitute any prize with another prize of equal or greater value.
Herald and News reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of Herald and News, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to Herald and News the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
Herald and News reserves the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or Herald and News. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and Herald and News are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
Herald and News reserves the right to change the rules at any time.
